These apply to products, not services
This page covers templates and source code bought from SMOALD. Work built for you under a contract is covered by the terms of service instead, where copyright transfers to you on final payment.
The short version
You buy a licence to use the code, not ownership of it. You can edit it as much as you like, and you can put it live wherever the tier you bought allows. What you cannot do is resell it as a template, or give it away.
The three tiers
Personal licence
- Use on one website or application that belongs to you
- Modify the code however you wish
- Use it for a commercial business of your own
- Full source code and documentation
Commercial licence
- Everything in Personal
- Use on websites you build for paying clients
- One purchase covers unlimited client projects
- Your client ends up with a working site; they do not receive a licence to reuse the template elsewhere
Extended licence
- Everything in Commercial
- Include the code inside a product you sell on — a SaaS application, a paid platform, a hosted service
- End users of your product may use it as part of your product
What no licence permits
- Reselling, redistributing or giving away the template itself, modified or not
- Publishing it in a public repository, a template marketplace, or a file-sharing site
- Building a competing template or theme product from it
- Sub-licensing it to somebody else as source code
- Removing copyright notices from the source files
In plain terms: build things with it, do not sell it on as the thing itself.
Attribution
None required. You do not have to credit SMOALD on any site you build.
Third-party components
Templates may include open-source libraries and web fonts that carry their own licences. Those remain under their own terms, which are listed in the documentation that ships with each product. They are all permissively licensed and free to use commercially, but they are not mine to relicense.
Updates and support
- Updates: free for 12 months from purchase. The licence itself does not expire — a site you have already built keeps working forever.
- Support: email support for 60 days from purchase, covering installation and anything that does not work as documented.
- Bug fixes: for 12 months.
- Not covered: writing custom features for you, debugging changes you have made, or general web development tuition. I offer those as paid services.
Transferring a licence
A licence can be transferred once — for instance when you sell the business it was bought for. Email me and I will move it across. It cannot be split across multiple people.
If the licence is breached
If a licence is used outside these terms it ends immediately, and continued use is a copyright infringement. In practice I would far rather email you and sort it out, so if you are unsure whether something is allowed, just ask first.
No warranty
Products are provided “as is”. I have built them carefully and I run the same code in production myself, but I cannot guarantee they will suit every purpose or run in every environment. My total liability is limited to what you paid. See the refund policy for what happens if something is genuinely wrong.
Questions
If your situation does not fit neatly into one of the three tiers, email joshua@smoald.com and I will tell you which one you need — or write you a custom one.
